SUMMARY
Rieth-Riley Construction Co., Inc., a leading heavy highway construction company in the Midwest, is seeking to hire an Associate Counsel – Contracts & Insured Claims Litigation for its Legal Department located at the corporate headquarters in Goshen, Indiana. The successful attorney candidate will report directly to the General Counsel. Areas of concentration will include, among other things: contracts, litigation, state and federal regulatory and statutory compliance, workers compensation, collections, and other matters as assigned by the General Counsel.
ESSENTIAL DUTIES AND RESPONSIBILITIES include the following. Other duties may be assigned.
Provide day-to-day legal advice, consultation, and support to Risk Management departments, as well as Rieth-Riley management and construction personnel, related to the overall minimization of company risk
Research and advise on current and developing statutory and federal construction law changes and trends and provide regular updates to the company’s internal contracts as needed
Review and negotiate Rieth-Riley’s company and non-company contracts in collaboration with the company’s construction planning and management personnel, and related matters
Develop solutions in conjunction with Rieth-Riley’s Risk Management department and advise Rieth-Riley’s construction personnel on matters related to construction site risk
Pursue and litigate collections and other small claims or manage outside counsel in such matters
Identify, engage and manage outside counsel in the defense of construction-related injury claims and interface with the Rieth-Riley’s insurance policy adjusters.
Manage and provide support on pre-litigation and litigation matters
Draft and coordinate responses to discovery
Develop and provide training to the company’s construction personnel and management on contracts processes
QUALIFICATIONS
J.D. degree from an accredited law school
Current admission to a state bar
At least 3-7 years of experience practicing complex contracts review and negotiation, as well as personal injury litigation
Outstanding oral and written communication skills
Integrity, adaptability, initiative, commitment, and ability to work independently
Personal injury/casualty background with litigation or litigation management experience preferred
Strong decision-making, interpersonal and collaboration skills
An ability to prioritize matters in a fast-paced environment and distill legal issues into practical counsel for construction personnel and company management
Occasional travel, primarily within Indiana and Michigan, required.
