T he Louisiana Department of Revenue (LDR) is responsible for fairly and efficiently collecting state tax revenues to fund public services, to regulate charitable gaming and the sale of alcoholic beverage and tobacco, and to support state agencies in the collection of overdue debts. Collectively, each program, unit, division and group work together to provide the core services to taxpayers of the State of Louisiana and stakeholders of the agency. LDR is comprised of the following groups: Tax Collection, Charitable Gaming, Alcohol and Tobacco Control (ATC), Debt Recovery, and Louisiana Tax Free Shopping Commission.

The Legal Unit includes litigation, mediation, formal settlement negotiations, participation in administrative hearings, regulatory oversight and policy planning and advisement. Types of litigation may include, but are not limited ID, appeals of administrative decisions, injunctive relief and declaratory judgments. In addition, legal counsel exercises general overview of the Tobacco licensing and regulatory functions conducted by the Business and Enforcement Divisions.

Duties include, but are not limited to:

Serves as a senior attorney in the legal division and serves as a specialist on the most complex alcoholic beverage and tobacco issues.

Serves as lead-worker over attorneys of lower rank.

Serves as a subject matter expert in interpreting cases arising out of Title 26, unfair trade practice law and disputes arising from tier issues with manufacturers, distributors and retailers.

Responsible for tax hearings and tobacco cash/credit hearings.

May represent the agency in litigation such as precedent case before trial and appellate courts and administrate tribunals by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs. Acts as liaison with other in-house counsel and outside counsel during litigation.

Supervises and manages legal staff to ensure that all functions are performed within the established work standards.

Responsible for managing the activities associated with hiring and developing subordinate staff appropriately including annual performance evaluations.

Prepares educational and advisory information regarding alcoholic beverage laws and regulations.

Prepares responses to alcoholic beverage inquires submitted by taxpayers.

Assists the ATC Commissioner and Deputy Commissioner as needed.

Minimum Qualifications

MINIMUM QUALIFICATIONS:

Possession of a license to practice law in the state of Louisiana, plus four years of experience as a practicing attorney.

Examples of Work

Plans, assigns, and reviews the preparation of briefs and other activities incidental to litigation and court work.

Drafts and reviews the drafting of new legislation. May testify on the same before legislative committees and other tribunals.

Testifies before legislative committee hearings on proposed tax law changes and current tax laws in the area of tax specification. Reviews proposed legislation introduced which affects area of tax specification.
