MINIMUM REQUIREMENTS & ESSENTIAL FUNCTIONS

Provides legal representation and consultation services for agency personnel on litigation, training, operational, and legislative matters as part of a collaborative team and performs the following duties. #oj

Minimum Requirements

At least 18 years of age.

Must be able to comprehend and communicate fluently in verbal and written English.

U.S. Citizen or possess a current permanent resident card.

Clean criminal history; any arrest history will be individually evaluated.

No illegal drug usage within the past year. Other drug usage will be evaluated on a case by case basis.

Must have a Law Degree AND must have three (3) years of experience and/or training in litigation and local government law with emphasis on criminal law and/or 42 U.S.C. sec. 1983 litigation.

If this posting indicates a degree is required, the following experience will apply in lieu of any degree as follows

Two (2) years of direct experience for an Associate Degree

Four (4) years of direct experience for a Bachelors Degree

Six (6) years of direct experience for a Masters Degree

Must have a Law Degree and must have three (3) years of experience and/or training in litigation and local government law with emphasis on criminal law and/or 42 U.S.C. sec. 1983 litigation.

Ability to remain current on developments in legislation and case law.

Ability to provide legal counsel to all OCSO components.

Ability to respond to requests for legal advice about agency business from OCSO personnel throughout the agency.

Ability to research legal issues.

Ability to prepare legal bulletins and legal opinions.

Ability to review or drafts contracts, policies, legislative proposals, and miscellaneous reports as requested.

Ability to prepare training materials, including presentations, handouts, lesson plans, and presents them at in-house training sessions. Attends staff meetings and reports information.

Ability to litigate forfeiture cases, public records lawsuits, risk protection petitions and other miscellaneous cases, generally at the trial court level and occasionally at the appellate court level.

Ability to handle motions to return property, rules to show cause, and other proceedings.

Ability to conduct nuisance abatement proceedings on behalf of the agency.

Ability to interface with the State Attorneys office, Judiciary, and other components of the local criminal justice system on behalf of the agency.

Ability to represent the agency during investigations/reviews conducted by state and federal agencies.

Ability to coordinate with outside counsel as needed on specialized assignments.

Ability to act as OCSO liaison for purposes of Florida Sheriffs Risk Management claims and litigation (e.g., tracks and documents case progress, consults with outside counsel about a variety of issues, represents the Sheriff at mediations and trials, etc.).

Ability to review administrative investigations that may result in termination.

Ability to review and draft contracts for goods and services, inter-local agreements, and memoranda of understanding with other agencies.

Ability to participate in collective bargaining preparations and negotiations and consult on other labor-related issues.

Ability to perform other tasks assigned by the General Counsel, such as providing feedback on support staff’s performance evaluations and standing in for the General Counsel in the General Counsel’s absence.

Ability to share 24/7 on-call duty with other staff attorneys.

Must have advanced skills to analyze, interpret, and write the most complex documents.

Must have the ability to respond in a timely manner and utilize discretion when handling confidential information and sensitive inquiries or complaints.

Must have advanced writing skills while using original or innovative techniques or style.

Must be able to create and administer effective and persuasive speeches and/or presentations on controversial or complex topics to senior management, public groups, jurors, and/or boards of directors.

Must have the ability to support the agency’s goals and objectives by utilizing discretion and independent judgment while performing essential job functions regarding matters of significance (i.e. complex legal issues, professionalism, confidentiality, etc.) on a daily basis.

Must have a comprehensive knowledge of Florida law in order to recite, apply, and demonstrate thorough & detailed understanding of the law.

Must have the ability to thoroughly identify problem areas when out of compliance with established standards and recommend changes to regain compliance as needed.

Must have basic computer skills to include word processing applications.

Must be able to build collaborative working relationships with internal and external stakeholders (i.e. senior staff, section commanders, OCSO employees, public & regulatory agencies and private citizens).
